Recently, Practice Notes blogger and attorney Ericka L. Adler addressed an HHS proposal to modify HIPAA to permit physicians and other healthcare providers to disclose otherwise protected health information (PHI) of individuals with certain mental health conditions to the National Instant Criminal Background Check System (NICS) without the individuals' prior authorization. 

But is compromising privacy ever fair to patients, even in the name of public safety?

Yes, public safety trumps any concerns about privacy.
No, patients are entitled to certain privacy rights under HIPAA and that shouldn't change.
